BCDC has issues a permit for some rip rap work on the Marina jetty. Since a pile of rocks has been dumped at the edge of the jetty, it would appear that this work is beginning at this time. This permit specifies:

  • In the Bay: "Place, use and maintain approximately 257 cubic yards of rock riprap material over an approximately 2,028-square-foot area for shoreline stabilization and protection against erosion."
  • On the Shoreline: "Place, use and maintain approximately 136 cubic yards of rock riprap material over an approximately 1,048-square-foot area for shoreline stabilization and protection against erosion."
  • The work is permitted to begin no later than June 30, 2011 (although it seems to be starting now) and be completed no later than June 30, 2012.
  • The permit states that this work will result in enlarging the Bay by approximately 1,578 square feet and providing approximately 16,339 squre feet of new public access along the shoreline.
August 12, 2010 According to Nader Mansourian, Asst Public Works Director, the surcharge work at the marina is NOT ready to proceed at this time because, "the applicant has not signed and finalized the grading permit and a lot of the details are not available yet." (see June 19, 2010 below)

This past week the San Rafael Department of Public Works issued a grading permit for the fill and surcharge process at the Loch Lomond Marina. The filling/surcharge is projected to commence in the next 2-3 weeks. This activity should begin with some site clearing west of Andy's Market, followed by fill import.

The Department of Public Works requires that the grading permit comply with the project conditions of approval (those approved by the City Council), which include, among others:

  • the implementation of a dust control plan;
  • the submittal and implementation of a SWPPP (storm water pollution prevention plan); and
  • the submittal and implementation of a grading logistics plan (essentially a phasing plan that includes logistics on how site access is to be maintained).

According to Paul Jensen, Planning Manager, San Rafael Planning Dept., the current owner (Oaktree Capital) is in negotiations with a potential buyer of the Loch Lomond Marina property. That potential buyer is a South Bay developer who has entered into contract to purchase the site. Their due diligence period is 30 days before the purchase is official and during which they may decline.

Also, the current project engineers of the Loch Lomond Marina project are preparing to submit a ‘surcharge plan’ to the San Rafael Dept. of Public Works by the end of April. The surcharge is the placement of quantities of dirt on top of the current site to compress the existing underlying sediment and mud in preparation for supporting the weight of the proposed construction. The Department of Public Works is awaiting the payment of processing fees prior to reviewing and acting on this permit request.

The City Attorney has finished reviewing the documents, agreements and cost estimates for the Mello-Roos District, which is required to be formed for the maintenance of the marina green, park and wetland area. He believes that on June 7, the City Council will be asked to adopt a resolution to initiate the formation of this district. This action is a formality, which means that the resolution will likely appear on the City Council consent calendar portion of the meeting agenda. The required, formal hearing on the district formation would be held later this summer.

Several status items regarding the Marina development:

  1. The developers are moving forward to start the surcharge process. A first draft of the grading plans was prepared for the City, but it was incomplete. The developers now need to revise their surcharge plans in order to submit a more complete version. At present, there is no short-term schedule on this activity.

  2. Draft subdivision improvement plans have been prepared and submitted for the first Final Map. The Public Works Department has reviewed them and pointed out a number of corrections that need to be made. As in the case with the surcharge plans, the comments have been forwarded to the developer and there is no immediate schedule for a re-submittal.

  3. The City has had a number of meetings with the developer regarding the formation process for the Mello-Roos District. The Mello-Roos District is required to ensure long-term funding of the shoreline park, marina green improvements and the seasonal wetland at the east end of the property. Detailed cost estimates and the appropriate formation documents have been prepared and the City will be meeting with the developer and attorneys before the end of this month to discuss. A public hearing to form this district will probably be held in March-April.

  4. The final landscape plans for the shoreline park and marina green have been completed and submitted. Per the conditions of approval, the final plans must go to the City's Park and Recreation Commission for approval. The Commission review is required to confirm that the conditions have been met. Since there can be no changes to the previously approved plans, just more details, no public hearing is required and there will not be a formal noticing to neighbors. This review will probably take place at the February 18th meeting of the Park and Recreation Commission. Persons interested in attending the review meeting, can check with the City to see if this review is on the agenda for February 18th.

  5. Harbormaster Pat Lopez has reported that he is about to submit additional information requested by BCDC concerning the needed repair at the end of the boardwalk. He expects the work to be completed soon.
August 5, 2009 State legislation (AB333), which has been signed by the governor, automatically gives a two-year extension to currently approved projects with valid maps. For the Marina project, this extends approvals to August 2012. Meanwhile, the owners have put this development on hold pending improved economic conditions. They are also looking to sell the property along with the entitlements to build the project.
